What Happened?
On October 30, 2013, J.B. was riding a Citi Bike on Lafayette Street in the bicycle lane. As he was approaching the East 4th Street intersection, a passenger in a taxi cab ahead abruptly opened the door into the bike lane. As a result, J.B. struck the door and sustained the following personal injuries to his hand:
- Displaced comminuted fracture and mid diaphyseal fracture of the fourth metacarpal – right hand;
- Injuries required open reduction and internal fixation surgery of the right hand;
- Disfiguring scarring on the right hand;
- Pain, tenderness, spasm and restricted range of motion of the right hand.

To be granted summary judgment, our team had to thoroughly prove that the Defendant’s negligence was a significant cause of the accident that resulted in J.B.’s injury. However, if the Defendant can provide admissible evidence that J.B. was negligent (whether in his speed or any other way), the motion would have been denied.
